Wedding Photography Package fee is as states unless otherwise arranged. A non-refundable booking fee of 25% is due at the signing of this agreement as a retainer for your date, with the balance to be paid two weeks prior to the wedding date. Payment plan options are available. ADDITIONAL EXPENSES: If applicable, the Client is responsible for all travel, accommodation, meal and transport costs, unless provided by the Client. Dinner to be provided by Bride + Groom, to be eaten at same time as Bride + Groom. 

WEDDING PACKAGE AND SERVICES INCLUDED FOR THE FEE STATED ABOVE

One Photographer services provided for the chosen wedding day package coverage-Minimum 400 Digital Wedding Images Fully “Polished” with print rights.-Online Image Gallery of Wedding Photographs. Option to purchase/upgrade album to larger size and add more pages at a later date.

ENTIRE AGREEMENT

This agreement contains the entire understanding between INFINITY PHOTOGRAPHY and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

PAYMENT, RETAINER + CANCELLATION POLICY

As a retainer/security deposit, 25% of the total of your package is due with this signed contract. The booking fee/security deposit is effective for saving your date. The remainder of your balance pays for all other services. Balance payable in full at least one month to 2 weeks prior to date of wedding. In the event of cancellation, the booking fee/security deposit paid is non refundable. It shall be liquidated damages to INFINITY PHOTOGRAPHY in the event of a breach of contract by client. The client shall also be responsible for payment for any INFINITY PHOTOGRAPHY materials charges incurred up to time of cancellation.

COPYRIGHT AND REPRODUCTION

The client agrees that all photographs taken by INFINITY PHOTOGRAPHY are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without INFINITY PHOTOGRAPHY’S explicitly written permission. Upon final payment by the client, LIMITED copyright ownership of the resulting images will be transferred to the client under the following conditions: 

>The digital negatives are the property of client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives. The client must obtain written permission from and/or compensate INFINITY PHOTOGRAPHY prior to the client publishing or selling the photographs for profit as it is a violation of federal copyright law.

>If the client gives digital copies to friends and relatives, the client must also require their friends and relatives to obtain written permission from and/or compensate Infinity Photography prior to publishing or selling the photographs for profit, as limited copyright ownership is granted to the client and they take full responsibility for who they give digital copies to. 

>The client agrees not to manipulate, touch/alter, enhance, etc. the photographs taken by INFINITY PHOTOGRAPHY in Adobe Photoshop, Cell Phone, VSCO, or any other program themselves, hire or have free services do so. The client must also let friends/family know they cannot manipulate, touch/alter, enhance etc. as it is a violation of federal copyright law. Any changes must be made by INFINITY PHOTOGRAPHY and INFINITY PHOTOGRAPHY alone, and we are happy to discuss any changes needed.

MODEL RELEASE

The client grants to INFINITY PHOTOGRAPHY and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs for the promotion of it’s business and services. Including but not limited to website, blog, studio display, internal and external promotional material, product demos, vendors, editorial, trade and advertising. The client hereby releases INFINITY PHOTOGRAPHY and its legal representatives and assigns from all claims and liability relating to said photographs.

HOUSE RULES + EXCLUSIVE PHOTOGRAPHER

The photographer is limited by the guidelines of the ceremony official or reception site management. Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is client’s responsibility; INFINITY PHOTOGRAPHY will offer technical recommendations only. It is understood that no other photographer, amateur or professional shall be allowed to photograph at the wedding near the Photographer while he/she is working due to reasons of INFINITYPHOTOGRAPHY delivering the quality of images as expected. Any breach of this agreement can constitute a reason for non-completion of the job (i.e. Infinity Photography missing importantphotographic moments due to guests, whether amateur or professional photographers, impeding Infinity Photography’s view) with no liability to INFINITY PHOTOGRAPHY.

VENDOR REQUESTS

Should any vendor(s) used by client (Bride & Groom) request photographs of their wedding day, the Bride & Groom must direct the vendor(s) to contact INFINITY PHOTOGRAPHY directly either by phone or email. INFINITY PHOTOGRAPHY is happy to supply any and all vendors with photographs with the request that credit be given to INFINITY PHOTOGRAPHY.

COOPERATION

The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. INFINITY PHOTOGRAPHY recommends that the client designate an “event guide” to point out important individuals for informal or candid photographs to the photographer during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. INFINITY PHOTOGRAPHY is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to INFINITY PHOTOGRAPHY. 

LIMIT OF LIABILITY

In the unlikely event that the photographer is injured or becomes too ill to photograph the event, INFINITY PHOTOGRAPHY will make every reasonable effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. INFINITY PHOTOGRAPHY takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond INFINITY PHOTOGRAPHY’S control, INFINITYPHOTOGRAPHY’S liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

FORCED RESCHEDULLING/CANCELLATION

In the event that Pandemic/Epidemic Conditions, Inclement Weather/Acts of God, or Changes to Local/Provincial/Federal Law occur thereby forcing the rescheduling of the event, INFINITY PHOTOGRAPHY will make every reasonable effort to accommodate scheduling needs (including replacing any member of INFINITY PHOTOGRAPHY) and apply remitted funds towards the rescheduled event. If the event is cancelled, INFINITY PHOTOGRAPHY will not be held liable for ANY funds remitted towards the cancelled event and said funds shall not returned but be considered liquidated damages to INFINITY PHOTOGRAPHY.

VOLUNTARY RESCHEDULING/CANCELLATION

Should the client choose to reschedule the event and should INFINITY PHOTOGRAPHY be available for the new date, the client may be charged a 10% administration fee. If the client reschedules and INFINITY PHOTOGRAPHY is NOT available for the new date, the client forfeits their deposit and any funds remitted to INFINITY PHOTOGRAPHY shall not be returned. If the client cancels the event, INFINITY PHOTOGRAPHY will not be held liable for ANY funds remitted towards the cancelled event and said funds shall not returned but be considered liquidated damages to INFINITY PHOTOGRAPHY.

PRE-EVENT TELEPHONE CONSULTATION

The parties agree to a pre-event consultation by phone or in-person one to three weeks before the event date in order to finalize the actual shooting times and locations. 

PRICING

2023 pricing is good during the year of 2023. Prices may increase in 2024. If clients wish to purchase additional products or add spreads to albums etc., they will be charged the current year pricing.

COMPLETION SCHEDULE + BACK-UP

Weddings take approximately 8-12 weeks to process, and INFINITY PHOTOGRAPHY will, to the best of their ability, keep to this timeline. Your photography collection will be available online within approximately 8-12 weeks of your event. Album designs will begin at this time. Albums take approximately 6 additional weeks to receive from the final approval and payment of any additional upgrades/spreads. INFINITY PHOTOGRAPHY will make every reasonable effort to keep digital negatives on file for 1 year from your wedding day. Please understand that when your images are delivered it is your responsibility to preserve and protect them. We encourage you

COPYRIGHT INFORMATION

What is copyright? Who owns what? Why all the fuss? How can I get copies made? These are all questions that frequently arise. 

This info sheet is designed to provide information to help our customers understand why professional photos cannot be copied. 

WHAT IS COPYRIGHT? 

The Canadian Intellectual Property Office and the Federal Copyright Act give “copyright” protection to “authors” for their “original works,” such as photographs. Among the protections that copyright owners have are the exclusive rights to: make copies of the work, prepare other works based on the original, distribute copies of the work to the public by sale, rental, lease, or lending, and to publicly perform and display the work. These rights are protected by laws which provide for damages and criminal penalties for violations. Both the customer and the lab that violates copyright are subject to the law. 

WHO OWNS WHAT? 

The law says the “author” is the owner of the copyright. The author of a photo or image is the person who snapped the shutter or created the image. If you took the photo, you own the copyright. If a professional photographer took the photo for you, then he or she owns the copyright. The digital negatives that you purchased along with your session, gives you the right to make unlimited reproductions of the images for personal use only. 

WHY ALL THE FUSS? 

The primary reason is economic. We invest a great deal of time and creative energy in creating the experience, idea, theme, setting, pose, lighting, background, and extra shots to get the right one. We have priced our session fees taking into account the fact that our customers will be purchasing their prints and products from us after the session. If the prints are obtained elsewhere, we lose the opportunity to recover funds for the effort expended. We are also very concerned about our artistic integrity. Since our name is associated with the photos, we want complete quality control over the quality of the products and reprints. Many people have no idea about copyright and think since they paid us to take a picture of them that they own the copyright. This is far from true. While you own the prints you purchased, you do not own the right to copy the work in any way. 

HOW CAN I GET COPIES MADE?

We highly recommend you contact INFINITY PHOTOGRAPHY directly to place any orders for prints or products you may need, or for a list of recommended locations. We can only guarantee the quality of printing that we are in control of.

FINES FOR COPYRIGHT INFRINGEMENTS

Fines for copyright infringement now exceed $250,000 CDN. dollars (per infringement). In other words, if someone takes a image that they did not capture and publishes it or reproduces it without the copyright owners consent, then they are liable and could be set to 5 years in prison and fined up to $250,000 for each violation.

WHAT CANT I DO?

A few examples of what is considered copyright infringement include: scanning photos, photocopying photos, screen captures and drag and dropping of online images (blog, website, Facebook etc.) for the purpose of printing, reproducing photos for yourself or others, etc. Anyone who is printing or sharing these photos should be printing and sharing from the digital negatives given to you by INFINITY PHOTOGRAPHY.Thank you in advance for adhering to these policies and respecting the value of our work!

CAN I SHARE OUR PHOTOS ON FACEBOOK OR INSTAGRAM OR TIKTOK OR SNAPCHAT OR...?

Yes! You certainly can! We want you to love them and share them with everybody you know! But remember, just say "No" to goofy filters that reduce hours of professional digital image processing to the passing fad of whatever is popular. Scroll to the bottom and yours or your friend’s Instagram account. Those mega-filtered posts from 2012 look exactly like mega-filtered posts from 2012.

CAN I PRINT MY PHOTOS ANYWHERE? Of course. While we offer high-quality printing options through your client gallery website, we're happy to see our work printed and hanging in our client’s homes! Print as many photos as you like, wherever you prefer to print them. But remember, we keep the prices in your client gallery competitive. It’s a couple bucks more than a chain store but the colour quality is amazing, and our family appreciates your support. 

CAN I MAKE DIGITAL COPIES FOR MYSELF AND MY FAMILY?

Yes! In fact, we encourage our clients to make digital copies of their photos and give a copy to each side of the family. That way, you are protected should tragedy strike. Technology can fail, so we back up all our photos on multiple computers, hard drives, and cloud services. We think you should do the same!

WAIT! COPYRIGHT GOBBLEDY-GOOK IS CONFUSING! WHO OWNS THE PHOTOGRAPHS? Through this contract, we give you consent to keep, copy, and print the photos. We hold the copyrights and raw negatives (for promotional/artistic reasons) and we grant you permission reproduce the digital JPEGs. Share away!

I WANT TO CREATE A COLLAGE OF BLACK AND WHITE PHOTOS. WHERE CAN I GET THOSE?

Just ask! There will be several Black & White photos in your collection, but if you have a special B&W request, we're happy to fulfill that request at no extra charge!

I ORDERED AN ALBUM! HOW THE HECK DOES THAT WORK?

Congrats! The albums are beautiful! We keep it simple. After your wedding is edited and delivered, we begin designing and ordering the albums. We do the design personally (after all, we were there!). It will include about 50-60 of the best photos from your wedding. After your glorious wedding album is designed, it’s ordered and shipped directly to your door!

DO I HAVE TO PAY IN 2 LUMP SUMS?

Nope! After the 25% retainer is paid, you may break up the remaining amount in whateverway works for your budget! The 2 most popular ways to pay the entire amount are: 

1.25% + 75%.  2.25% + 25% + 50%.

ARE THE HOURS CONSECUTIVE OR MAY WE BREAK UP THE COVERAGE THROUGHOUT THE DAY?
